By visiting or shopping at ByValenti.com, you accept these conditions. Please read our terms carefully. In addition, when you use any current or future By Valenti Organics service or business (e.g., My Account, Gift Cards, e-Gift Certificates, Wish List, Reviews, Testimonials) you will also be subject to the guidelines, terms and conditions ("Terms") applicable to such service or business. If these conditions are inconsistent with such Terms, the Terms will control.

You are welcome to submit suggestions, comments via our contact us form system. By submitting any content, images or feedback you grant By Valenti Organics a non-exclusive, royalty free, perpetual and irrevocable right to use, reproduce, publish, modify and distribute in any way and media. By submitting any content you warrant the content you provide is accurate and that you hold rights of such content.

Customer Accounts

Customer Account Registration: An account can be created at any time and by anyone to place orders, for easy login, store shipping addresses, to maintain wish-lists for family and friends, to check the status of orders placed and to verify and track orders. When you register for an account you are requested to provide a password and your personal information. Your financial information cannot and will not be stored in your account. You are responsible for maintaining the confidentiality of your login ID and password and are responsible for all activities that your account can incur.

Checkout Without An Account: Checkout without an account is offered to anyone wanting to order from By Valenti Organics and not wanting to register and maintain an account.

Flagged Customer Accounts: A customer account can get flagged or banned for any of the following reasons:
    * An account was created without the authorization of the owner,
    * False or unverifiable information was used during the creation of the account,
    * Suspicious credit card activity.

Luxurious VIP Membership Program:

Luxurious VIP Membership Program is a worldwide loyalty membership program. Benefits include but are not limited to:

Product Reviews and Testimonials

Visitors and customers may post reviews & testimonials, send e-gift certificates, and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a any content. By Valenti Organics reserves the right (but not the obligation) to remove or edit such content. If you do post content or submit material, and unless we indicate otherwise, you grant By Valenti Organics a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant By Valenti Organics and sublicensees the right to use the name that you submit in connection with such content, if they choose to do so. You represent and warrant that you own or otherwise control all of the rights to the content that you post, that the content is accurate, that use of the content you supply does not violate this policy and will not cause injury to any person or entity, and that you will indemnify By Valenti Organics for all claims resulting from content you supply. By Valenti Organics has the right but not the obligation to monitor and edit or remove any activity or content. By Valenti Organics takes no responsibility and assumes no liability for any content posted by you or any third party.

Orders - In Stock Product

Orders placed on products that are available in stock will be shipped within 2-3 business days after payment is processed and approved.

Pre-Orders - Out of Stock Products

Due to the way we manufacture many of our products, some are marked fully as "Out of Stock" without the possibility to place an order, while some although in stock, can't be shipped until a certain date. These products can be pre-ordered but clearly they state, right below the "Add to Bag" button, when the product will be available to ship. By placing an order on a product that would be in stock at a later date, you agree your entire order will not be shipped until the product becomes available in stock on the date specified on the product listing page. Your credit card won't be charged until your entire order is ready to ship.

Payment:

All sales throughout this website are made in US$.

Pay by Credit Card: US and International Customers have the choice of paying with Visa, Master Card, American Express and Discover through our merchant account. To pay with your credit card simply enter your information in the Payment area during checkout. All Credit Card transaction are encrypted and processed online through a Secure Socket Layer (SSL) Connection but your credit card is not charged immediately when you place the order. To pay by phone simply call 586-275-7373. Have your Order & Credit Card numbers ready. Your purchase will appear as "MVALENTI LLC" in your statement.

Pay by Mail-in Order: US Customers have the option of paying with Personal/Business Checks and Money Orders from the Unite States Postal Service. For security reasons we do not accept Money Orders from Western Union. Mail-in Orders paid with Personal/Business Checks need 7-10 business days for checks to clear the bank before orders can be shipped.

Taxes:

A 6% sales and use tax will be applied to all customers in Michigan.

Dishonored Checks, Bad Checks, Insufficient Funds Checks, Returned Checks:

As established by the law in the State of Michigan, a $25 Returned Check Fee will be added to any order paid with a Personal/Business check that has been returned by the bank for insufficient funds/no account. The total of the order plus $25 Returned Check Fee shall be paid within 7 business days, excluding weekends and holidays. Failure to comply will result in additional fees, attorney fees and civil/criminal sanctions as established by the law in the State of Michigan.

As established by the law in the State of Michigan, a $35 Returned Check Fee will be added to any order paid with a Personal/Business check that has been returned by the bank for insufficient funds/no account. The total of the order plus $35 Returned Check Fee shall paid within 30 days including weekends and holidays. Failure to comply will result in additional fees, attorney fees and civil/criminal sanctions as established by the law in the State of Michigan.

Gift Cards and e-Gift Certificates:

By Valenti Organics Gift Cards (Biodegradable Gift Cards) and e-Gift Certificates (Electronic Gift Certificates) are issued by Manuela Valenti, LLC. We do not charge any dormancy fees, penalty fees or replacement fees for lost or stolen Gift Cards. Your funds will be available always in your account. By Valenti Organics Gift Cards and e-Gift Certificates cannot be reloaded, returned, resold, transferred for value, redeemed for cash or applied to any other account, except in states where required by law. Unused Gift Card balances in an Amazon account may not be transferred. Resale of By Valenti Organics Gift Cards and e-Gift Certificates is strictly prohibited.

By Valenti Organics Gift Cards and e-Gift Certificates may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities (including without limitation via websites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless prior written approval is requested.

Gift Cards or e-Gift Certificates are only redeemable online at www.byvalenti.com towards the purchase of eligible products. Gift Cards and e-Gift Certificates cannot be used to purchase other Gift Cards or e-Gift Certificates or applied to any other containing another Gift Card or e-Gift Certificate. Gift Cards or e-Gift Certificates cannot be used to purchase Luxurious VIP Memberships. By Valenti Organics reserves the right to cancel any order if a Gift Card or e-Gift Certificate is used to purchase more Gift Cards or e-Gift Certificates or Luxurious VIP Memberships. Purchases are deducted from the Gift Card or e-Gift certificate balance. Any unused balance will be placed in the recipient's Gift Card or e-Gift Certificate account when redeemed. If an order exceeds the amount of the Gift Card or e-Gift Certificate, the balance must be paid with a credit card or other available payment method. By Valenti Organics will have the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Card or e-Gift Certificate is redeemed and/or used to make purchases on byvalenti.com.

Lost or stolen Gift Cards cannot be replaced without the original receipt. If your Gift Card is lost or stolen, immediately contact us. Your Gift Card will be cancelled and we will issue a new one with the remaining balance. By Valenti Organics shall have no liability to you for (i) lost or stolen Gift Cards or (ii) use of any Gift Cards or e-Gift Certificates by third parties through your ByValenti.com account. You are solely responsible for keeping the password for your ByValenti.com account safe and for any activity conducted under your account.

When you purchase, receive, or redeem a By Valenti Organics Gift Card or e-Gift Certificate, you agree that the laws of the State of Michigan shall govern these Terms and Conditions, without regard to principles of conflict of laws.

eco-Reward Cards & Secret eco-Reward Cards:

Eco-Reward Cards and Secret eco-Reward Cards are promotional, loyalty cards issued by Manuela Valenti, LLC during promotions and specials and are given to selective recipients or qualified participants during promotional or special events. Eco-Reward Cards and Secret eco-Reward Cards, are not covered by the Cart ACT of 2009, do have an expiration date, cannot be re-charged, are not returnable or refundable for cash. All the funds in the eco-Reward Cards & Secret eco-Reward Cards expires with the expiration date on the front of the card and are valid during the promotion described on the card. When you receive, or redeem a By Valenti Organics eco-Reward Card or Secret eco-Reward Card, you agree that the laws of the State of Michigan shall govern these Terms and Conditions, without regard to principles of conflict of laws.

Discount Coupons, Vouchers and Promotional or Promo Codes:

Discount Coupons/Vouchers/Promo Codes cannot be used on already discounted products. By Valenti Organics reserves the right to cancel any order where a discount coupon, voucher or promo code has being used on already discounted products or specials due to a human or technical error on byvalenti.com.
Discount Coupons/Vouchers/Promo Codes values, expiration date and restrictions are specified on the Discount Coupons/Vouchers/Promo Codes and can be verified online at http://www.byvalenti.com/index.php?main_page=discount_coupon.
Discount Coupons/Vouchers/Promo Codes are valid only online at byvalenti.com and cannot be redeemed through any of our distributors.
Limit one coupon per household per purchase.
Discount Coupons/Vouchers/Promo Codes are not valid on taxes, shipping & handling or any other charges.
Discount Coupons/Vouchers/Promo Codes may not be combined with other offers or sales.
Discount Coupons/Vouchers/Promo Codes cannot be replaced if lost or stolen.
Discount Coupons/Vouchers/Promo Codes are not redeemable for cash and are do not abide by the Credit Card Act.
If a Discount Coupons/Vouchers/Promo Codes is used and your entire order is cancelled or rejected, or if you return all items in your order, you will be refunded the actual amount paid and your coupon will no longer be valid.
By Valenti Organics reserves the right to discontinue or invalidate a coupon, voucher or promotional code at any time and for any reason.

Daily Deal Vouchers:

Additionally to the Discount Coupons/Vouchers/Promo Codes conditions established above the following conditions in this paragraph apply to Daily Deal Vouchers.

Vouchers also called Discount Coupons or Promotional (Promo) Codes can be purchased through selected verified Daily Deal Partners in the form of pre-discounted sales. Our Daily Deal Partners are authorized to process the pre-sale and provide you with a full Voucher/Discount Coupon/Promo Code with a unique code redeemable only at byvalenti.com.

Vouchers/Discount Coupons/Promo Codes have established expiration dates. Expired Vouchers/Discount Coupons/Promo Codes can only be redeemed for the pre-paid value of the Vouchers/Discount Coupons/Promo Codes and not for the full face value.

By purchasing the Voucher/Discount Coupon/Promo Code from any of our verified Daily Deal Partners during their promotional periods, you agree the Voucher/Discount Coupon/Promo Code is not in any way to be treated as a Gift Card or e-Gift Certificate and does not abide by the Credit Card Act and that the Terms & Conditions of our Daily Deal Partners cannot and will not override our Terms & Conditions in any way.

You agree any amount exciding the Voucher/Discount Coupon/Promo Code face value needs to be paid in full prior to the shipping of your order. If for any reason your credit card, check/money order are denied, your entire order will be placed on hold until full payment for the excess amount of your order is paid. If order is paid with check, and check is returned from bank for insufficient funds/no account additional fees may apply as established above in the Dishonored Checks, Bad Checks, Insufficient Funds Checks, Returned Checks paragraph of this Terms & Conditions.

Vouchers/Discount Coupons/Promo Codes are not redeemable for cash as established above in the Discount Coupons/Vouchers/Promo Codes section of this Terms & Conditions. The rest of Terms & Conditions established above for Discount Coupons, Vouchers and Promotional Codes apply to the Daily Deal Vouchers.

Shipping:

We ship Monday through Friday, excluding federal holidays and weekends within the United States. Shipping charges are calculated online directly by the United States Postal Service (USPS) through the checkout process based on the weight of the package and destination of the package. We don't ship to PO Boxes. Insurance costs are included in the shipping cost regardless of size of package and destination. All orders are shipped by USPS within 3 business days of payment being received and effective if stock is available. Out of stock orders will be shipped when items become available. Worldwide shipment available. To calculate your shipping costs, simply add any of the items to cart and click the estimate shipping button. Tracking number and Delivery confirmation are provided with every shipment. Shipping charges are non-refundable costs related to your order. Under no circumstances shipping charges will be refunded either by the United States Postal Services or By Valenti Organics.

Orders placed after 5:00 PM (EST) will be processed the next business day. Orders received on Saturday and Sunday will be processed on the following business day.

By Valenti Organics is not responsible for undeliverable packages. If USPS has attempted delivery 3 times according to their policies, and they are unable to deliver to the shipping address given, USPS will automatically redirect the package back to the By Valenti Organics warehouse. The customer will be responsible for all shipping charges incurred during this process.

For Canadian and International Customers: Shipping charges are based on the weight of your parcel and will be accurately displayed in the shopping cart (subject to offline verification). Please note that customs, duties, taxes, and other import fees may be imposed on shipments separately from the shipping cost by the country of destination. By Valenti Organics cannot and will not be responsible for these charges. We urge you to check with local authorities regarding customs, duties, taxes and import charges prior to ordering if you are not already familiar with them. Finalizing and submitting your order indicates your acceptance of any duties and taxes your country of destination may impose.

Shipping Insurance:

For the protection of your package and its content, insurance charges are mandatory on every order on all delivery methods and are calculated automatically by the United States Postal Services and included in the shipping costs calculates by our shopping cart.

Free Shipping Options:

* Free shipping available for retail customers on orders over $85 within the Continental United States. There is no free shipping option available for wholesale customers. Wholesale customers will pay the regular shipping charges applied which are calculated based on the destination and weight of the package. Please read Shipping terms above.

Package Forwarding Services:

The use of third party Package Forwarding Services and addresses in the US provided by third party Package Forwarding Services to expedite the shipment of orders to countries outside of the USA are not allowed to be used to order from this website. By Valenti Organics is not responsible or liable for any package lost or damaged by any third party Package Forwarding Services. Any shipping & handling and insurance services paid to ship orders to the address in the United States of America provided as the destination address for and by the Package Forwarding Services company will be rendered invalid after the package is received by the Package Forwarding Services company and won't apply nor be refunded if package is lost or suffers damage while in the custody or after delivery by the Package Forwarding Services company. Once the package arrives to its destination address in the US we're not responsible for any damages or losses the package might suffer; any insurance coverage on the package will therefore be void after the package reaches its destination address in the US; any shipping, handling and insurance costs paid upfront to By Valenti Organics to ship merchandise to the address in the US provided by the Package Forwarding Services company won't be refunded; any partial or complete loss in merchandise suffered while the package is in the custody or after package is delivered by the third party Package Forwarding Services, won't be refunded or replaced.

Damaged or Lost Items During Shipping:

It is normal for outside boxes and envelopes to show sign of wear, however if the content was damaged, please notify us immediately and report this issue to your carrier. If the outside box looks severely damaged, if possible refuse the shipment and request the driver to note all the details. Damage or loss incurred during shipping is the delivery company's responsibility. Since all our orders ship with insurance from the United States Postal Office, claims must be properly filed with the delivering carrier (USPS) online or at your local post office. Please take pictures of the box and content to record any damage. Keep all the packaging material as you may need to show the condition in which you received your order. Only shipments that are insured can claim the total of the loss, minus shipping or delivery charges, to be reimbursed by the delivery company. Although the addressee must initiate damage claims against the shipper, we will be happy to assist you in all we can. By filing a claim with the United States Postal Office you cannot request a refund from By Valenti Organics.

Returns, Exchanges and Refunds:

We are committed to our customer's satisfaction, however due to the nature of our products some might not be returned if they have already been used. You can return items that have not been used, show signs of damage and that have not being opened only. You will still be responsible for any return shipping costs. Merchandise may be returned by mail within 30 days of purchase and should be accompanied by the following:

request a Return Authorization Number,
original receipt, which was sent by email (you can also get a receipt by login into your account and print the receipt for your order),
unopened, undamaged and unused product(s). If product is opened or damaged we can't issue a refund.

If you need to return a product for a refund or exchange please Request a Return Authorization Number. We cannot accept returns without the corresponding authorization number. If you mail back a product without the proper authorization number a refund will not be granted and the package will be sent back to you at your cost and expense.

Returns & Refunds will be processed as Store Credit (Gift Card or e-Gift Certificate) only.

Exchanges will be mailed to the address you provide on the Request a Return Authorization form, after we've received your returned product. Exchanges can only be processed for products with the same exact or higher value. If you want to exchange your product for a product with a higher value, select below "Return & Refund - exchange for a higher value product". Any difference along with applicable shipping charges will have to be paid in full before any merchandise is shipped back.

*Original Shipping Charges and Return Shipping Costs are non-refundable nor pre-paid, no exceptions.

Items that cannot be returned or refunded:

Gift Cards,
e-Gift Certificates,
Daily Deal Vouchers and Products,
Samples and Gifts,
Used Products,
Individual products part of a set,
Damaged products during shipping.

Custom Duties and Taxes for International Orders:

Any custom duties, taxes and any other charge that the country of destination might apply are the responsibility of the customer. The shipping and handling charges do not include any custom duties that your country might impose. We do not mark packages as gifts or samples. This is an illegal practice in the US.

Our products are not intended to be used on babies. Typographical Errors:

In the event and error in price or description on the site is spotted, we reserve the right to refuse and/or cancel any order that might have taken place during the removal or correction of the error. If your credit card, was charged during this time we will notify you of the error prior to reimburse your payment and cancel your order.
